Affiliates - Terms and Conditions
Yain Technology's Affiliate Program enables users to add certain links and promotional features to their websites for which they will be eligible for compensation in accordance with, and subject to, these Terms and Conditions. Yain Technology reserves the right, in its sole discretion, to alter the Program at any time for any reason or for no reason at all. Acceptance of Subscription
By registering as an Affiliate, you have agreed to receive emails from us regarding news, products and promotion. This means that you will entitle a commission of 50% for all ebooks (downloadable electronic form) shown in the Link Codes under the Affiliate's Login site. As for tangible products like Thai amulets, Tibetan dZi beads, anti-virus software, etc, your commission will vary from 5% - 15% depending on individual product. If you need to know, kindly email us for more information about the commission for that particular product. For the first $50 commission, it will be retained for any refund to be made. Thereafter, all commission will be credited at the end of the following month after the sale is completed. When there is a refund, the retain $50 will be deducted for the refund amount.
Promotion of Our Affiliate Relationship
By registering for the Program and accepting these Terms and Conditions, the Affiliate represents and warrants that he or she can lawfully bind him or herself to these Terms and Conditions and can legally participate in the Program in the jurisdiction(s) where Affiliate is located. No Affiliate may participate in the Program if doing so is prohibited by any law or regulation having the force of law applicable to Affiliate.
Our Responsibilities
We will be responsible for providing all information necessary to allow you to make appropriate Links from your site to our site. We will be solely responsible for processing every order placed by a customer following a special Link from your site, for tracking the volume and amount of sales generated by your site, and for providing information to Affiliate Sites regarding sales statistics.
Commission Payment
We will hold your first $50 in case of any refund. Thereafter, all your commission will be paid through PayPal at the end of each month. Don't have a PayPal Account - Click Here to open an account to credit your commission.
Statistics
You will be given a username and a password to check your affiliate statistics anytime you want in real time.
Term of the Agreement
By registering for the Program and accepting these Terms and Conditions, Affiliate represents and warrants that his/her web site(s) does not and will not contain, display, promote or include obscene, indecent, violent, discriminatory, illegal, pornographic, or adult content, including, but not limited to, text, audio, video, graphics and images. By registering for the Program and accepting these Terms and Conditions, Affiliate represents and warrants that his/her web site(s) contains and displays content (including, but not limited to, text, audio, video, graphics and images) in addition to the links, promotional materials, and branding made available to the Affiliate. The term of this Agreement will begin upon our acceptance of your Affiliate application and will end when terminated by either party. Either you or we may terminate this Agreement at any time, with or without cause, by giving the other party written notice of termination. You are only eligible to earn commission on sales occurring during the term.
Modification
We may modify any of the terms and conditions contained in this Agreement at any time in our sole discretion. You will be notified by email and a change notice will be posted on our site. Modifications may include, but are not limited to, changes in the scope of available commissions, commission schedules, payment procedures, and Affiliate rules. If any modification is unacceptable to you, your only recourse is to terminate this agreement. Your continued participation in the Affiliate Program following our posting of a change notice or new agreement on our site will constitute binding acceptance of the change.
Information Submitted by Affiliate
By accepting these Terms and Conditions, Affiliate represents and warrants that all information submitted by Affiliate in registering for the Program is true, accurate, current, and complete; and that Affiliate shall maintain and update information submitted in registering for the Program in order to keep it true, accurate, current and complete at all times. If any information that Affiliate submits in the registration process is untrue, inaccurate, not current or incomplete, Yain Technology shall have the right to terminate Affiliate's participation in the Program.
Relationship of Parties
Affiliate will not claim or hold itself out as claiming any sponsorship by, endorsement by, or affiliation with Yain Technology or its parent corporation, subsidiary corporations, successors, and assigns. You and Yain Technology are independent contractors, and nothing in this Agreement will create any partnership, joint venture, agency, franchise, sales representative, or employment relationship between the parties. You will have no authority to make or accept any offers or representations on our behalf. You will not make any statement, whether on your site or otherwise, that reasonably would contradict anything in this Section.
Use
You may only refer other companies or individuals. You will not be credited for sales made by you, the affiliate account holder.
Indemnification
You hereby agree to indemnify and hold harmless Yain Technology against any and all claims, actions, demands, liabilities, losses, damages, judgments, settlements, costs, and expenses (including reasonable attorneys' fees) (any or all of the foregoing hereinafter referred to as "Losses") insofar as such Losses.
Spamming
We strictly prohibits the sending of unsolicited mass e-mails of any kind. If a member is reported for "spamming", Yain Technology will investigate and terminate the member's account. Spamming mean sending unsolicited and unauthorized e-mails to businesses and individual who do not know you personally and have not agreed to receive your messages. Please report spamming to Spam Abuse. Be sure to including the following in your report:
